Terms of Service

These Terms and Conditions (“Terms”) govern the use of the online platform Whenyoumeetlocals.com (also “Platform”). These Terms apply both to clients (also “Users”) and to Oppa and Unnie.

Your access and use of the Platform constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Whenyoumeetlocals.com. If you do not agree to these Terms, you may not access or use the Platform.

– “User” (also “client”) means a person who is interested in tour services.

– “Oppa” or “Unnie” means a person who guides TRAVELERs to tour places.

WHENYOUMEETLOCALS(WYML) is an online global platform that connects OPPA and UNNIE who are passionate and ready to entertain TRAVELERs who wish to explore the place more plentifully (“WYML Services”). WYML services can be accessed and used via the webpage (“Site”). Please read these Terms carefully as using the Site, irrespective of whether you become a registered user of the Services or not, you accept these Terms in full. If you disagree with these Terms or any part of these Terms, you must not use the Site or Services.

 

Use of WYML Services

User Accounts/ Oppa and Unnie Registration
In order to use and access full WYML Services, including the features like booking, you must register and create an account and become a user. You can create the account by directly signing up following the registration guideline provided by the Site, or using different signup features WYML allows. By creating an account, you agree to provide true, precise and complete personal information, consenting to comply with terms of service and other policies WYML has (Information collected will be subject to our Privacy Policy).


If you wish to become an Oppa/Unnie and provide Services to Travelers, you must first submit our Oppa/Unnie Application Form which will be reviewed and affirmed by WYML. Without our affirmation, Users cannot use WYML Service as an Oppa/Unnie. We reserve the right to deny and accept your application. During the process of the application, we require additional information (Information collected will be subject to our Privacy Policy) and by applying for an Oppa/Unnie, you agree to provide true, precise, and complete personal information. Due to safety concern, OPPA/UNNIE Application Form requires you to provide your criminal record. If you do not have any previous convictions and questionable issues on your record, you can simply check No on the form. However, if it’s not the case, you are required to provide a criminal record. Please be aware any form of PERJURY/FALSE INFORMATION WILL BE SUBJECTED TO LEGAL ACTION.

Feedback 
Travelers who use services can provide comments on posted Service and rate the Oppa/Unnie they rented. WYML will monitor the comments to provide a pleasant environment for Users, but WYML do not bear legal responsibility for any pejorative or offensive feedbacks.

Content
We own the WYML Content and the Services, which are protected by copyright, trademark, patent, trade dress or other proprietary rights and laws. Thus, WYML grants you limited license to reproduce and display the WYML Content solely for your personal use in viewing the Site or using the Services. You may not modify, reproduce, distribute, create related works, publicly display or in any way exploit any of the WYML Content except when authorized by us.

 

Rescheduling Policy

If you need to reschedule your tour, please notify us via email, text or live chat with at least 3days prior notice.

Notification of rescheduling from the User is as follows:

– More than 3 days before the scheduled tour: Can change the place, date and time once(GMT+9:00).

– Less than 3 days before the scheduled tour: Can change the place only(GMT+9:00).

– The day of the tour: No change(GMT+9:00).

 

Cancellation/Refund Policy
In case you will not be able to attend the tour please contact us as soon as possible and we will do our best to rearrange the date of the tour however we cannot guarantee that Oppa/Unnie would be free on other date/time.

If the tour is cancelled due to faults of Oppa/Unnie or a systematic error, we will fully refund you. Please note that we will always try to do our best to reschedule your tour so there will be no need for cancellation fees.

Notification of cancellation from the User is as follows:

– More than 3 days before the scheduled tour: Get a 90% refund(GMT+9:00).

– Less than 3 days before the scheduled tour: Get a 50% refund(GMT+9:00).

– The day of the tour or no show: No refund(GMT+9:00).

 

Payment Policy

The binding prices are in USD (US dollars). We do not have any control over the foreign exchange rates set by banks and bear no responsibility for the foreign exchange conversion rates used by the payment gateway, paypal, your bank or payment card provider.

 

Profile Changes and Cancellation of User Profile
At any time, you may request for editing, correcting or deleting any of your personal profile information. For the cancellation and removal of your account from WYML and on any matters that extend the usual management of your account, you may contact  WYML through live chat with such specific request. WYML shall terminate your account and remove any information pertaining to you from the WYML Service within reasonable time upon receiving your request for account cancellation. We will attempt to comply with any request to the best of our capabilities.

Misconduct and Report
We care for your safety. If you believe a User acted inappropriately including (but not limited to) offensive, violent or sexually inappropriate behavior, please report immediately such person to the appropriate authorities and to us.

 

Restrictions
We reserve the right at all times to investigate and take appropriate action at our sole discretion against anyone who violates this provision. Prohibited Content or Activity is as follows. We may immediately permanently suspend a User if the User violates relevant laws,

A. Violates or infringes other users’ rights, privacy or intellectual property.
B. Incites racism, sexual discrimination, or any type of offensive or malicious act against any group or individual.
C. Creates false, illusive, misleading information or activities
D. Generates promotion or commercial information without WHENYOUMEETLOCALS’s prior consent.
E. Provides or provokes illegal or unlawful activities.
F. Deliberately writes biased comments for the benefit of another party.
H. Solicits personal information from other users.

 

Privacy Policy

Any information that you provide in the Services is subject to our 'Privacy Policy'. By agreeing to these Terms, you are also consenting to our use of your personal information in accordance with our Privacy Policy.

 

Modification

WYML reserves a full discretion to modify or end WYML Services with or without notice. By using or accessing WYML Services, you understand and agree that WHENYOUMEETLOCALS bears no legal responsibility to you for any modification, abeyance, or termination of WYML Services. The Company may change WYML’s layout and design from time to time, and the availability of the content and services included therein, without giving any prior notice on WYML. You hereby agree and acknowledge that WYML is not responsible for any errors or malfunctions that may occur in connection with the performing of such changes. 

 

Links to Third Party Websites

WYML may contain links to third party websites, whether such links have been suggested by the Company or shared by any. You hereby acknowledge that the Company has no control over such Third Party Sites, and you further acknowledge and agree that the Company is not responsible for the availability of Third Party Sites, and does not endorse and is not responsible or liable for any services, content, advertisements, products, or any materials available on such Third Party Sites. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss whatsoever caused, or alleged to be caused, by or in connection with use of or reliance on any services, content, products or other materials available on or through any Third Party Sites. Most Third Party Sites provide legal documents, including terms of use and privacy policy, governing the use of such sites. It is always a good idea to read such documents carefully before using those sites.

 

Advertisements

The Company may integrate commercials, advertisements and/or sponsored links, whether within or beside WYML. By clicking the advertisements you may be transferred to a website of an advertiser or receive any other messages, information or offers from the advertiser and from others. All the information contained in such commercials and advertisements belongs solely to the advertisers and the Company makes no warranties or representations as to such advertisements, whether or not the Company has control over such advertisements. The Company, advertisers and/or third parties related thereto may be entitled to certain shares of the earnings for such commercials. You agree, acknowledge and consent that no right, title or interest is or shall be granted to you in any way with respect to any revenue share whatsoever in relation thereto, whether as a paying User or not.

 

Limitation of Liability

The Use of WHENYOUMEETLOCALS and participation in any service is solely at your own risk. WYML disclaims all liability to the maximum extent permitted by law.

 

About these Terms
We may modify these terms or any additional terms that apply to WYML Service to, for example, reflect changes to the law or changes to our WYML Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for WYML Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of WYML Service.


If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
These terms control the relationship between WHENYOUMEETLOCALS and you. They do not create any third party beneficiary rights.
If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).


If it turns out that a particular term is not enforceable, this will not affect any other terms.

Governing Law and Jurisdiction

Disputes that arise between the WHENYOUMEETLOCALS and the User shall be governed by the laws of the Republic of Korea.
Lawsuits surrounding disputes that arise between the WHENYOUMEETLOCALS and the User shall be brought to the jurisdiction of the User's address at the time the lawsuit is filed. If no address is available, the lawsuit shall be brought to the district court that has jurisdiction over the User's place of residence. However, if the User's address of place of residence is unknown at the time of the lawsuit, the lawsuit shall be brought to the competent court stated in the Civil Procedure Act.
All disputes that arise between the WHENYOUMEETLOCALS and the User with an overseas address or place of residence shall be brought exclusively to the Seoul Central District Court of the Republic of Korea, despite the previous Clause.
